1. About Summit Metabolic Health

Summit Metabolic Health PLLC ('Summit,' 'we,' 'us,' or 'our') is a physician-led telehealth practice founded by Paul Anthony Miranda, MD, a board-certified Family Medicine physician. Summit provides metabolic health services including GLP-1 therapy (semaglutide, tirzepatide), weight management, and hormone optimization to patients in licensed states.

Summit is currently licensed to provide telehealth services in: Tennessee, Florida, Georgia, Washington, and Ohio. Services are only available to residents of these states.

2. Scope of Services — Not Emergency Care

Summit Metabolic Health does not provide emergency medical services. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.

Summit does not replace your primary care physician. You are encouraged to maintain a relationship with a primary care provider and to share your Summit treatment plan with that provider.

3. Eligibility

To enroll in Summit Metabolic Health, you must:

  • Be at least 18 years of age.

  • Be a legal resident of a state in which Summit holds an active medical license.

  • Complete a full clinical intake evaluation and be deemed an appropriate candidate by Summit's physician.

  • Not have active contraindications to GLP-1 therapy as determined during clinical evaluation.

Enrollment does not guarantee prescription of any specific medication. All prescribing decisions are made solely at the physician's clinical discretion.

4. Telehealth Consent

By enrolling, you consent to receive medical services via telehealth, including asynchronous evaluation and management. You understand that:

  • Telehealth services may involve delays in communication and evaluation.

  • Technology failures may interrupt or prevent services.

  • Telehealth is not appropriate for urgent or emergency conditions.

  • You have the right to refuse telehealth services and seek in-person care.

A separate Telehealth Informed Consent document will be provided during intake and must be signed prior to initiation of clinical services.

5. Subscription Plans and Billing

Summit Metabolic Health operates on a cash-pay subscription model. We do not bill insurance. Subscription fees are charged monthly in advance on your enrollment anniversary date.

Subscription Phases: Pricing transitions through clinical phases (Onboarding, Active, Maintenance) as determined by your physician. Current pricing is published at summitmetabolichealth.com/pricing.

Medication Costs: Compounded GLP-1 medications are dispensed through Aspire Pharmacy (Sugar Land, TX), a licensed 503A compounding pharmacy. Medication costs are billed separately by the pharmacy.

Failed Payments: If your payment method fails, Summit will attempt to collect for up to 7 days. Failure to resolve may result in suspension of clinical services, including prescription refills.

No Insurance Reimbursement: Summit does not submit claims to insurance, Medicare, or Medicaid. Fees may or may not be reimbursable under your HSA or FSA; consult your plan administrator.

6. Cancellation and Refund Policy

You may cancel at any time by contacting support@summitmetabolichealth.com or through your Healthie patient portal. Cancellations must be received at least 5 business days before your next billing date.

Refunds: Monthly subscription fees are non-refundable once the billing cycle has begun. Onboarding fees are non-refundable if your intake evaluation has been completed. Medication orders that have been processed and shipped are non-refundable.

7. Referral Credit Program

Summit Metabolic Health offers a Subscriber Referral Credit to active patients who refer a new patient to the practice.

How it works:

When a person you refer enrolls and completes their first 30 days as an active subscriber, you will receive a $33.00 credit applied to each of your next three (3) consecutive monthly invoices ($99.00 total value).

Program Terms:

  • Credits are non-transferable, non-refundable, and have no cash value.

  • You must be an active subscriber at the time each credit is applied. Credits do not carry forward if your subscription lapses.

  • The referred patient must be a new patient with no prior Summit enrollment.

  • Summit reserves the right to modify or discontinue this program with 30 days' notice.

Important Clarification: This credit is a subscriber appreciation benefit — not compensation for a medical recommendation. Summit does not pay referral fees to patients or third parties.

FTC Disclosure Requirement (16 C.F.R. Part 255): If you share your experience publicly after receiving a referral credit, you must disclose the material connection. Example: "I am a patient of Summit Metabolic Health and received a subscription credit for referring a friend."

8. Prescribing, Clinical Decisions, and Standard of Care

All clinical decisions are made solely by Summit's licensed physician(s) in accordance with applicable standard of care. You agree to disclose your complete and accurate medical history. Failure to disclose accurate information releases Summit from liability for adverse outcomes attributable to incomplete disclosure.

Lab Requirements: Summit may require baseline and periodic laboratory testing as a condition of continued prescribing. Failure to complete required labs may result in suspension of prescription services.

9. Compounded Medications and Pharmacy

Summit partners with Aspire Pharmacy (Sugar Land, TX), a licensed 503A compounding pharmacy, for compounded GLP-1 medications prepared pursuant to valid physician prescriptions using non-standard dosing schedules not available in commercial fixed-dose pens. We are happy to send prescriptions to your own pharmacy also, we offer a coaching only pathway. We will not be able to help with prior authorizations of any sort. Prescriptions for adjunctive medications will be sent to your pharmacy of choice.

Important: Compounded medications are not FDA-approved drug products. Summit does not manufacture, compound, ship, or guarantee medication quality. Pharmaceutical liability rests with the dispensing pharmacy.

10. Privacy and HIPAA

Summit Metabolic Health is a Covered Entity under HIPAA. Your PHI is handled per Summit's Notice of Privacy Practices (effective March 15, 2026), available at summitmetabolichealth.com.

Summit uses Healthie (HIPAA-compliant EMR) as its primary clinical platform. All clinical communications should be conducted through the Healthie patient portal. Non-encrypted SMS and personal email are not HIPAA-secure.

11. Educational Content and Intellectual Property

Summit's patient education materials — including the Ten Commandments of GLP-1 Success program, care plans, and all written content — are proprietary intellectual property of Summit Metabolic Health PLLC. Personal, non-transferable license granted for individual health management only. No reproduction, distribution, or commercialization without written permission.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUMMIT METABOLIC HEALTH PLLC, ITS PHYSICIAN(S), STAFF, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Summit's total aggregate liability shall not exceed subscription fees paid in the three (3) months preceding the claim.

13. Dispute Resolution and Governing Law

Governed by the laws of the State of Tennessee. Disputes submitted first to good-faith mediation; if unsuccessful, resolved by binding arbitration in Hamilton County, Tennessee under AAA rules. Class action waiver applies.

14. Modifications to These Terms

Summit reserves the right to modify these Terms at any time. Material changes communicated via email at least 30 days before taking effect. Continued use after effective date constitutes acceptance. Current version always at summitmetabolichealth.com/terms.
